Terms of Service for Potoroo

Potoroo is operated by Frank Lu, an individual developer.

1. Acceptance of Terms

By downloading, installing, or using Potoroo, you agree to these Terms. If you do not agree, do not use the app.

2. Who May Use Potoroo

You may use Potoroo only in compliance with applicable laws and these Terms. You are responsible for activity that occurs on your device and under your Apple account. The service is intended for users age 13+. If you are under the age of majority where you live, use Potoroo only with parent or guardian permission.

3. App Functionality

Potoroo is a local-first writing app. Content is stored on-device by default. Optional iCloud sync features are provided through Apple's services and depend on your Apple account status and device settings.

4. User Content

You retain ownership of the content you create in Potoroo, including text, attachments, and templates. You are responsible for the legality and rights clearance of any content you store or sync.

5. Acceptable Use

You may not use Potoroo to violate laws, infringe intellectual property rights, or attempt to reverse engineer, interfere with, or misuse the app beyond rights granted by applicable law.

6. Third-Party Services

Potoroo relies on Apple services for certain features, including iCloud (CloudKit and iCloud Key-Value Store), notifications, and in-app purchases (StoreKit/App Store). Those services are governed by Apple's terms and privacy policies.

7. In-App Purchases

Paid features, if offered, are processed by Apple. Billing, subscription management, refunds, and purchase disputes are handled under App Store rules and your Apple account terms.

8. Availability and Changes

We may modify, suspend, or discontinue app features at any time. Features that depend on Apple or platform APIs may change based on those providers.

9. Termination

You may stop using Potoroo at any time. We may suspend or terminate access to app features if needed to protect users, comply with law, or enforce these Terms.

10. Backups and Data Responsibility

You are responsible for backing up data you care about. While we aim for reliability, data loss can happen due to device issues, platform failures, or user actions.

11. Disclaimer of Warranties

To the maximum extent permitted by law, Potoroo is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising from use of Potoroo.

13. Governing Law

These Terms are governed by the laws of Japan, excluding conflict-of-law rules. Any dispute will be resolved in the courts of Tokyo, Japan, unless applicable law requires otherwise.

14. Severability and Waiver

If any part of these Terms is found unenforceable, the remaining sections will remain in effect. If we do not enforce a provision immediately, that is not a waiver of our right to enforce it later.

15. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a new effective date.
